This is kind of annoying. I'm curious though. There has to be some sort of game theoretic equilibrium to this type of situation. At some point there has to be an advantage in breaking the agreement. Facebook, for example, doesn't seem to have been a part of this, and they've been like a huge vacuum sucking up all the talent in Silicon Valley for years now, if I understand correctly.
